1. Agreement to Terms

Welcome to VitaVibe! These Terms of Service ("Terms") govern your use of the VitaVibe mobile application ("App") operated by Andreas Løkken Wefring ("we," "us," or "our").

By downloading, installing, or using VitaVibe, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

VitaVibe is a wellness application that provides:

• 🌊 Haptic meditation experiences using your device's vibration features
• 🎨 Custom haptic pattern creation tools
• 📊 Progress tracking and statistics
• ☁️ iCloud synchronization across devices
• 🔔 Daily reminder notifications
• 🎁 Referral rewards program

The App is designed to support your wellness routine and is not intended to diagnose, treat, cure, or prevent any medical condition.

3. Eligibility

VitaVibe is available to users of all ages (rated 4+). However:

• Users under 13 years of age require parental consent to create an account
• Users under 18 require parental consent for in-app purchases
• You must have a compatible Apple device (iPhone 6s or newer with iOS 15.0+)

By using VitaVibe, you represent that you meet these eligibility requirements.

4. User Accounts

👤Account Creation

• You may use VitaVibe as a guest or create an account with your email address
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information when creating an account
• You are responsible for all activities that occur under your account

🔐Account Security

• Notify us immediately of any unauthorized access to your account
• We are not liable for any loss resulting from unauthorized use of your account
• You may enable Face ID or Touch ID for additional security

🗑️Account Deletion

• You may delete your account at any time through the App settings
• Upon deletion, all your data will be permanently removed within 30 days
• Deletion does not entitle you to a refund for any unused subscription period

5. Subscriptions & Payments

💳Free and Premium Tiers

VitaVibe offers both free and premium subscription options:

• Free Tier: Basic haptic patterns, streak tracking, daily reminders, limited sessions
• Premium Tier: Unlimited custom patterns, iCloud sync, advanced statistics, ad-free experience

💰Pricing & Billing

• Premium subscription is billed annually at the price displayed in the App
• A 7-day free trial is available for new subscribers
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

🔄Cancellation & Refunds

• You can cancel your subscription anytime through your Apple Account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple according to their refund policy
• We do not provide prorated refunds for partial subscription periods

6. Referral Program

• Users can earn rewards by referring friends to VitaVibe
• Referral rewards are granted when the referred user completes their first session
• Referral codes must not be publicly posted or distributed through mass channels
• We reserve the right to modify or terminate the referral program at any time
• Abuse of the referral system may result in account suspension

7. User Content

🎨Custom Patterns

• You retain ownership of any custom haptic patterns you create
• By creating patterns, you grant us a license to store and sync them for your personal use
• Custom patterns are for personal use only and may not be sold or commercially distributed

📋Your Responsibilities

• You are solely responsible for any content you create within the App
• You agree not to create content that is illegal, harmful, or violates these Terms

8. Acceptable Use

You agree NOT to:

• ❌ Use the App for any illegal purpose
• ❌ Attempt to reverse engineer, decompile, or hack the App
• ❌ Interfere with or disrupt the App's functionality
• ❌ Create multiple accounts to abuse the referral system
• ❌ Share your account credentials with others
• ❌ Use automated systems or bots to access the App
• ❌ Attempt to circumvent subscription requirements
• ❌ Resell or redistribute the App or its content

9. Intellectual Property

• VitaVibe and all its content, features, and functionality are owned by Andreas Løkken Wefring
• The App is protected by copyright, trademark, and other intellectual property laws
• The VitaVibe name, logo, and branding are our trademarks
• Pre-made haptic patterns included in the App are our intellectual property

📜License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use VitaVibe for personal, non-commercial purposes, subject to these Terms.

10. Health Disclaimer

If you have any medical conditions, particularly:

• Epilepsy or seizure disorders
• Heart conditions or pacemakers
• Anxiety disorders
• Any condition that may be affected by vibrations

Please consult with a healthcare professional before using VitaVibe.

11. Limitation of Liability

To the maximum extent permitted by law:

• VitaVibe is provided "AS IS" without warranties of any kind
• We do not guarantee uninterrupted or error-free operation
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months
• We are not responsible for any health issues arising from use of the App

12. Indemnification

You agree to indemnify and hold harmless Andreas Løkken Wefring from any claims, damages, losses, or expenses arising from:

• Your use of VitaVibe
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or share through the App

13. Third-Party Services

VitaVibe uses the following third-party services:

• Firebase (Google): Authentication and data storage
• RevenueCat: Subscription management
• Apple iCloud: Data synchronization
• Apple App Store: App distribution and payments

Your use of these services is subject to their respective terms and policies.

14. Termination

We may terminate or suspend your access to VitaVibe:

• Immediately, without prior notice, for violation of these Terms
• If we discontinue the App entirely (with reasonable notice when possible)
• For any reason at our sole discretion

Upon termination:

• Your license to use the App is revoked
• You may lose access to your data and custom patterns
• Provisions that should survive termination will remain in effect

15. Changes to Terms

• We reserve the right to modify these Terms at any time
• Changes will be posted with an updated "Last Updated" date
• Continued use of VitaVibe after changes constitutes acceptance
• For material changes, we will notify you through the App or via email

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of VitaVibe shall be resolved in the courts of Oslo, Norway.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Andreas Løkken Wefring regarding VitaVibe and supersede any prior agreements.
